Apakah uang Anda hangus begitu saja?<\/p>\n<p data-path-to-node=\"13\">Jawabannya: <b data-path-to-node=\"13\" data-index-in-node=\"12\">Belum tentu hangus, tapi perjuangannya tidak mudah.<\/b><\/p>\n<p data-path-to-node=\"14\">Dalam hukum kepailitan, ketika developer bangkrut, semua asetnya disita oleh negara di bawah pengawasan <b data-path-to-node=\"14\" data-index-in-node=\"104\">Kurator<\/b>. Di sinilah Anda harus bergerak cepat. Diam berarti uang hilang.<\/p>\n<p data-path-to-node=\"15\">Berikut adalah panduan &#8220;Survival Mode&#8221; jika developer Anda kolaps di tahun 2026.<\/p>\n<h2 data-path-to-node=\"16\"><b data-path-to-node=\"16\" data-index-in-node=\"0\">Pahami Posisi Anda Bukan Prioritas Utama<\/b><\/h2>\n<p data-path-to-node=\"17\">Pahit memang, tapi Anda harus tahu faktanya. Dalam UU Kepailitan, posisi konsumen pembeli rumah biasanya hanyalah <b data-path-to-node=\"17\" data-index-in-node=\"114\">Kreditur Konkuren<\/b>.<\/p>\n<p data-path-to-node=\"18\">Artinya, Anda adalah prioritas terakhir. Saat aset developer dijual lelang oleh Kurator, hasil penjualannya akan dipakai dulu untuk membayar:<\/p>\n<ol start=\"1\" data-path-to-node=\"19\">\n<li>\n<p data-path-to-node=\"19,0,0\"><b data-path-to-node=\"19,0,0\" data-index-in-node=\"0\">Pajak Negara<\/b> (Kreditur Preferen).<\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"19,1,0\"><b data-path-to-node=\"19,1,0\" data-index-in-node=\"0\">Bank\/Pemberi Utang Beragunan<\/b> (Kreditur Separatis).<\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"19,2,0\">Baru sisanya dibagi-bagi ke <b data-path-to-node=\"19,2,0\" data-index-in-node=\"28\">Pembeli Rumah<\/b> (Kreditur Konkuren).<\/p>\n<\/li>\n<\/ol>\n<p data-path-to-node=\"20\">Karena Anda ada di antrean belakang, kecepatannya mendaftar sangat menentukan apakah Anda masih kebagian &#8220;kue&#8221; sisa aset atau tidak.<\/p>\n<h2 data-path-to-node=\"21\"><b data-path-to-node=\"21\" data-index-in-node=\"0\">Langkah 1 Pantau Pengumuman PKPU<\/b><\/h2>\n<p data-path-to-node=\"22\">Biasanya sebelum Pailit, developer akan masuk masa <b data-path-to-node=\"22\" data-index-in-node=\"51\">PKPU<\/b> (Penundaan Kewajiban Pembayaran Utang). Kurator WAJIB mengumumkan ini di dua surat kabar nasional.<\/p>\n<p data-path-to-node=\"23\">Segera hubungi kontak Pengurus\/Kurator yang tertera di koran tersebut. Jangan tanya satpam proyek, mereka tidak tahu apa-apa.<\/p>\n<h2 data-path-to-node=\"24\"><b data-path-to-node=\"24\" data-index-in-node=\"0\">Langkah 2 Segera Daftarkan Tagihan Anda<\/b><\/h2>\n<p data-path-to-node=\"25\">Ini langkah paling krusial. Kurator akan memberikan <b data-path-to-node=\"25\" data-index-in-node=\"52\">Batas Waktu Akhir<\/b> pendaftaran tagihan utang. Jika Anda telat lapor 1 hari saja, Anda dianggap melepaskan hak Anda. Uang Anda resmi hangus.<\/p>\n<p data-path-to-node=\"26\">Bawa bukti-bukti ini ke kantor Kurator:<\/p>\n<ul data-path-to-node=\"27\">\n<li>\n<p data-path-to-node=\"27,0,0\">PPJB Asli &amp; Fotokopi.<\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"27,1,0\">Bukti transfer DP &amp; Angsuran (Rekening Koran).<\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"27,2,0\">KTP &amp; NPWP.<\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"27,3,0\">Formulir pengajuan tagihan (minta ke Kurator).<\/p>\n<\/li>\n<\/ul>\n<h2 data-path-to-node=\"28\"><b data-path-to-node=\"28\" data-index-in-node=\"0\">Opsi Damai Melanjutkan Pembangunan<\/b><\/h2>\n<p data-path-to-node=\"29\">Tidak semua kasus pailit berakhir dengan refund uang (karena biasanya kas developer sudah kosong).<\/p>\n<p data-path-to-node=\"30\">Solusi yang sering terjadi (Homologasi) adalah: <b data-path-to-node=\"30\" data-index-in-node=\"48\">Pembangunan dilanjutkan oleh Developer Baru (Investor Takeover) atau oleh Bank.<\/b> Biasanya Bank yang menyalurkan KPR (seperti BTN atau Mandiri) akan berkepentingan agar rumah jadi supaya kredit Anda tidak macet.<\/p>\n<p data-path-to-node=\"31\">Jika opsi ini yang diambil, bersyukurlah. Meski serah terima molor 1-2 tahun, setidaknya Anda tetap dapat rumahnya.<\/p>\n<p data-path-to-node=\"33\">Membeli rumah inden memang seperti berjudi jika salah memilih mitra.
