Total Rp 60 juta uang keras sudah masuk ke rekening developer. Tiba-tiba, surat penolakan (SP3K) dari bank keluar: KPR Anda ditolak.<\/p>\n<p data-path-to-node=\"13\">Dengan berat hati Anda melapor ke developer, berharap uang kembali. Namun, jawaban yang Anda terima dingin dan mematikan: <i data-path-to-node=\"13\" data-index-in-node=\"122\">&#8220;Mohon maaf Pak\/Bu, sesuai Pasal 5 di PPJB yang sudah Bapak tanda tangani, pembatalan karena sebab apapun membuat seluruh uang yang masuk hangus 100%.&#8221;<\/i><\/p>\n<p data-path-to-node=\"14\">Apakah Anda harus pasrah merelakan Rp 60 juta lenyap begitu saja? <b data-path-to-node=\"14\" data-index-in-node=\"66\">Jawabannya: TIDAK.<\/b><\/p>\n<p data-path-to-node=\"15\">Di artikel ini, saya akan membongkar kenapa klausul &#8220;Uang Hangus&#8221; seringkali <b data-path-to-node=\"15\" data-index-in-node=\"77\">cacat demi hukum<\/b> dan bagaimana cara Anda melawannya secara legal.<\/p>\n<h2 data-path-to-node=\"17\"><b data-path-to-node=\"17\" data-index-in-node=\"0\">Dasar Hukum: Menggugat &#8220;Klausul Baku&#8221;<\/b><\/h2>\n<p data-path-to-node=\"18\">Banyak developer berlindung di balik kalimat sakti: <i data-path-to-node=\"18\" data-index-in-node=\"52\">&#8220;Kan Bapak sudah tanda tangan, berarti setuju.&#8221;<\/i><\/p>\n<p data-path-to-node=\"19\">Padahal, dalam hukum perlindungan konsumen di Indonesia, tanda tangan tidak serta merta melegalkan isi perjanjian jika perjanjian itu melanggar Undang-Undang.<\/p>\n<p data-path-to-node=\"20\">Anda wajib tahu <b data-path-to-node=\"20\" data-index-in-node=\"16\">Pasal 18 Ayat (1) UU No. 8 Tahun 1999 tentang Perlindungan Konsumen (UUPK)<\/b>. Pasal ini secara tegas <b data-path-to-node=\"20\" data-index-in-node=\"115\">MELARANG<\/b> pelaku usaha (developer) membuat klausul baku yang:<\/p>\n<ol start=\"1\" data-path-to-node=\"21\">\n<li>\n<p data-path-to-node=\"21,0,0\">Menyatakan pengalihan tanggung jawab pelaku usaha.<\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"21,1,0\">Menyatakan bahwa pelaku usaha berhak menolak penyerahan kembali uang yang dibayarkan atas barang\/jasa yang dibeli.<\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"21,2,0\">Menetapkan aturan sepihak yang mengikat konsumen.<\/p>\n<\/li>\n<\/ol>\n<p data-path-to-node=\"22\"><b data-path-to-node=\"22\" data-index-in-node=\"0\">Konsekuensinya:<\/b> Jika PPJB Anda memuat pasal yang menyatakan uang hangus mutlak tanpa alasan yang adil, maka pasal tersebut <b data-path-to-node=\"22\" data-index-in-node=\"123\">batal demi hukum<\/b>. Artinya, pasal itu dianggap tidak pernah ada.<\/p>\n<h2 data-path-to-node=\"24\"><b data-path-to-node=\"24\" data-index-in-node=\"0\">Membedah Jenis Uang: Tanda Jadi vs Uang Muka<\/b><\/h2>\n<p data-path-to-node=\"25\">Agar argumen Anda kuat saat mediasi, pahami dulu status uang Anda:<\/p>\n<h3 data-path-to-node=\"26\"><b data-path-to-node=\"26\" data-index-in-node=\"0\">1. Booking Fee (Uang Tanda Jadi)<\/b><\/h3>\n<ul data-path-to-node=\"27\">\n<li>\n<p data-path-to-node=\"27,0,0\"><b data-path-to-node=\"27,0,0\" data-index-in-node=\"0\">Sifat:<\/b> Bukti keseriusan untuk memblokir unit agar tidak dijual ke orang lain.<\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"27,1,0\"><b data-path-to-node=\"27,1,0\" data-index-in-node=\"0\">Risiko:<\/b> Umumnya <b data-path-to-node=\"27,1,0\" data-index-in-node=\"16\">HANGUS<\/b> jika pembatalan datang dari sisi konsumen (misal: berubah pikiran, tidak suka desain). Ini wajar sebagai ganti rugi waktu bagi developer.<\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"27,2,0\"><b data-path-to-node=\"27,2,0\" data-index-in-node=\"0\">Pengecualian:<\/b> Jika pembatalan karena kesalahan developer (misal: izin IMB bermasalah, bangunan mangkrak), booking fee <b data-path-to-node=\"27,2,0\" data-index-in-node=\"118\">WAJIB KEMBALI<\/b> plus denda.<\/p>\n<\/li>\n<\/ul>\n<h3 data-path-to-node=\"28\"><b data-path-to-node=\"28\" data-index-in-node=\"0\">2. Down Payment (Uang Muka)<\/b><\/h3>\n<ul data-path-to-node=\"29\">\n<li>\n<p data-path-to-node=\"29,0,0\"><b data-path-to-node=\"29,0,0\" data-index-in-node=\"0\">Sifat:<\/b> Pembayaran bertahap atas harga pokok barang.<\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"29,1,0\"><b data-path-to-node=\"29,1,0\" data-index-in-node=\"0\">Hukum:<\/b> Uang ini adalah hak konsumen sampai barang diserahterimakan. Jika batal beli (terutama karena <i data-path-to-node=\"29,1,0\" data-index-in-node=\"101\">force majeure<\/i> seperti ditolak bank), uang ini <b data-path-to-node=\"29,1,0\" data-index-in-node=\"147\">TIDAK BOLEH HANGUS 100%<\/b>.<\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"29,2,0\"><b data-path-to-node=\"29,2,0\" data-index-in-node=\"0\">Kewajaran:<\/b> Developer boleh memotong biaya administrasi (biasanya 10-20% dari total uang masuk) untuk biaya marketing dan operasional yang sudah keluar. Tapi mengambil 100% adalah tindakan <b data-path-to-node=\"29,2,0\" data-index-in-node=\"188\">Pemerkayaaan Tanpa Hak (<i data-path-to-node=\"29,2,0\" data-index-in-node=\"212\">Unjust Enrichment<\/i>)<\/b>.<\/p>\n<\/li>\n<\/ul>\n<h2 data-path-to-node=\"31\"><b data-path-to-node=\"31\" data-index-in-node=\"0\">Strategi &#8220;Pagar Betis&#8221; Sebelum Tanda Tangan PPJB<\/b><\/h2>\n<p data-path-to-node=\"32\">Jangan menunggu masalah terjadi. Saat Anda disodorkan draf PPJB atau Surat Pemesanan Rumah (SPR), lakukan langkah preventif ini:<\/p>\n<ol start=\"1\" data-path-to-node=\"33\">\n<li>\n<p data-path-to-node=\"33,0,0\"><b data-path-to-node=\"33,0,0\" data-index-in-node=\"0\">Cari Klausul Pembatalan:<\/b> Baca teliti pasal tentang &#8220;Pembatalan&#8221; atau &#8220;Wanprestasi&#8221;.<\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"33,1,0\"><b data-path-to-node=\"33,1,0\" data-index-in-node=\"0\">Lakukan &#8220;Coretan Tangan&#8221;:<\/b> Jika tertulis <i data-path-to-node=\"33,1,0\" data-index-in-node=\"40\">&#8220;Uang hangus 100% jika KPR ditolak&#8221;<\/i>, coret kalimat tersebut di hadapan marketing.<\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"33,2,0\"><b data-path-to-node=\"33,2,0\" data-index-in-node=\"0\">Tulis Klausul Tambahan:<\/b> Minta marketing menuliskan (atau Anda tulis sendiri dan diparaf kedua belah pihak):<\/p>\n<blockquote data-path-to-node=\"33,2,1\">\n<p data-path-to-node=\"33,2,1,0\"><i data-path-to-node=\"33,2,1,0\" data-index-in-node=\"0\">&#8220;Apabila KPR ditolak oleh Bank Pemberi Kredit (bukan karena pembatalan sepihak konsumen), maka Uang Muka akan dikembalikan 100% (dikurangi biaya admin Rp &#8230;).&#8221;<\/i><\/p>\n<\/blockquote>\n<\/li>\n<\/ol>\n<p data-path-to-node=\"34\">Dokumen dengan coretan\/tulisan tangan yang diparaf kedua pihak memiliki kekuatan hukum yang mengikat dan bisa mengalahkan klausul cetakan standar.<\/p>\n<h2 data-path-to-node=\"36\"><b data-path-to-node=\"36\" data-index-in-node=\"0\">Langkah Taktis Jika Uang Sudah Terlanjur Ditahan<\/b><\/h2>\n<p data-path-to-node=\"37\">Jika Anda sudah terlanjur tanda tangan dan developer tetap keras kepala menahan uang Anda, jangan emosi. Lakukan eskalasi bertahap:<\/p>\n<ol start=\"1\" data-path-to-node=\"38\">\n<li>\n<p data-path-to-node=\"38,0,0\"><b data-path-to-node=\"38,0,0\" data-index-in-node=\"0\">Surat Permohonan Refund (Soft Approach):<\/b> Ajukan surat resmi, lampirkan bukti penolakan bank. Minta pengembalian dengan potongan wajar.<\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"38,1,0\"><b data-path-to-node=\"38,1,0\" data-index-in-node=\"0\">Somasi (Hard Approach):<\/b> Jika diabaikan, kirim Surat Peringatan (Somasi). Kutip <b data-path-to-node=\"38,1,0\" data-index-in-node=\"79\">Pasal 18 UUPK<\/b> yang saya sebutkan di atas. Ancam bahwa tindakan menahan uang konsumen secara sepihak bisa dilaporkan ke BPSK.<\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"38,2,0\"><b data-path-to-node=\"38,2,0\" data-index-in-node=\"0\">Lapor BPSK (Badan Penyelesaian Sengketa Konsumen):<\/b> Ini adalah jalur &#8220;maut&#8221; bagi developer nakal. Proses di BPSK cepat (maksimal 21 hari kerja), gratis, dan putusannya final mengikat. BPSK hampir selalu berpihak pada konsumen dalam kasus klausul baku yang tidak adil.<\/p>\n<\/li>\n<\/ol>\n<hr data-path-to-node=\"35\" \/>\n<p data-path-to-node=\"39\">Uang Anda adalah keringat Anda. Jangan biarkan hangus hanya karena selembar kertas perjanjian yang berat sebelah.
